Welcome to Cloudy - Voice Journal ("Cloudy", "we", "our", or "us"), an application created and operated by Navy. By downloading, installing, or using Cloudy, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the application.

1. Description of Service

Cloudy is a voice journaling application that allows users to record, transcribe, and manage personal audio journals. The app is designed with a privacy-first approach, meaning we do not require you to create an account with us to use the core features of the app.

2. Privacy and Data Handling

Your privacy is a core component of how Cloudy operates. While a complete overview of our data practices is available in our Privacy Policy, your agreement to these Terms includes an understanding of the following:

• Voice Recordings & On-Device Transcription: Your raw audio recordings and the initial speech-to-text transcription process happen entirely and securely on your local device. We do not have access to your voice recordings. If you choose to enable cloud backups, your recordings are securely synced via your personal Apple iCloud account.
• AI Text Processing: If you enable AI features, only the localized text transcript is sent to Google AI for rewriting and enhancement (text-to-text processing). Your data is not used to train Google's AI models, and the text is only processed for the purpose of providing the rewriting service to you.
• Opting Out of AI: You have the right to disable AI functionality in the app's settings at any time. If disabled, all processing and storage remain strictly on your local device or Apple's secure servers via iCloud.
• User Feedback Form: The app includes an optional feedback form. Any information, text, or data you voluntarily enter and submit through this form is sent directly to us. We use this information solely for the purpose of reviewing user feedback and improving the app.

3. Subscriptions, Free Trials, and Payments

Cloudy offers premium features that require a subscription. All payments, subscriptions, and refunds are handled entirely by Apple via the App Store.

• Free Trial: We may offer a 7-day free trial for our premium features. Unless cancelled before the end of the trial period, you will be automatically charged the subscription fee.
• Billing and Cancellation: You can manage or cancel your subscription at any time through your Apple ID Account Settings.
• Refunds: Because all transactions are processed by Apple, we cannot issue direct refunds. Any refund requests must be submitted directly to Apple Customer Support in accordance with Apple's App Store policies.

4. Third-Party Services

To provide our services, Cloudy utilizes several trusted third-party providers:

• Apple Services: For app distribution, iCloud storage, and subscription processing.
• Google Services: For processing AI text-to-text enhancements.
• Cloudflare: For secure and optimized network routing.
• Analytics: We collect anonymized diagnostic data (such as crash reports and feature usage metrics) to improve the app. This data is entirely anonymous, is not linked to your personal identity, and is only collected where necessary to maintain app stability and guide future updates.

5. Acceptable Use

Although Cloudy does not use a traditional account creation system, you must still use the app responsibly. You agree not to:

• Misuse the AI features, which includes submitting fake or automated requests, attempting to manipulate or bypass the AI's underlying instructions (prompt injection), or using the AI for purposes outside of personal journaling.
• Reverse engineer, decompile, or attempt to extract the source code of the app.
• Use the app for any illegal, harmful, or fraudulent activities.
• Interfere with or disrupt the security, servers, or networks connected to the app.

6. Termination and Access Restriction

We reserve the right to suspend, restrict, or terminate your access to Cloudy at our sole discretion, without notice, if we determine that you have violated these Terms (such as abusing the AI systems) or engaged in unauthorized use of the application.

7. Disclaimer of Warranties

Cloudy is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive to provide highly accurate AI rewriting and a stable app experience, we make no guarantees regarding the complete accuracy, reliability, or availability of the app. You acknowledge that AI-generated text may occasionally contain errors or unexpected outputs.

8. Limitation of Liability

To the maximum extent permitted by law, Navy shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, loss of profits, or business interruption arising out of your use or inability to use Cloudy. Because your data is stored locally or on your personal iCloud, you are solely responsible for ensuring your journals are properly backed up.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in New Zealand.

10. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide reasonable notice within the app prior to any new terms taking effect. By continuing to use Cloudy after those revisions become effective, you agree to be bound by the revised terms.
